Welcome to Stress Less (the “Service”), a mental health companion chatbot accessible via WhatsApp or in-browser chat. These Terms of Use (“Terms”) govern your access to and use of the Service. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.If you do not agree to these Terms, please do not use the Service.

2. Service Description
Stress Less is designed to offer general advice, tips, and information related to stress and anxiety. While we strive to provide helpful and relevant information, Stress Less is not a substitute for professional medical or mental health advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions about your mental health or a medical condition.

3. Not an Emergency Service
– No Crisis Support: If you feel that you or any other person may be in danger or if you have a medical emergency, please call 911 (US) or your local emergency services immediately.
– No Medical Advice: The Service’s content is for general informational and educational purposes only and should not be used as a replacement for professional health services.

4. Eligibility
By using the Service, you represent and warrant that:
– You are at least 18 or older years of age (or have the consent of a parent or legal guardian if minors are allowed to use the Service in your jurisdiction).
– You have the legal capacity and authority to agree to these Terms.

5. User Responsibilities
1. Accurate Information: You agree to provide accurate and up-to-date information, if and when requested, and to keep such information current.
2. Personal Use Only: Your use of the Service is for personal, non-commercial purposes.
3. Prohibited Conduct: You agree not to misuse, abuse, or exploit the Service in any manner that could harm others or disrupt the Service. This includes, but is not limited to, reverse-engineering, hacking attempts, or harassment of other users.

– Data Handling: Use of the Service is also subject to our Privacy Policy. Please review it carefully to understand how we handle your information.
– Third-Party Providers: We partner with Chatbase to provide infrastructure for the chatbot. Your messages (including phone number) are routed via WhatsApp’s end-to-end encryption and processed by Chatbase. Refer to the Privacy Policy for more details.

7. Intellectual Property
– Ownership: All content, features, and functionality provided by or through the Service (including text, graphics, logos, and software) are owned by us or our licensors and are protected by intellectual property laws.
– Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written permission.

8. Payment & Subscription
– As of the last update of these Terms of Use, the use of the Service is free of charge.
– The Service may offer both free and premium (paid) features. For premium features or subscription plans, additional terms and conditions may apply.

9. Disclaimer of Warranties
– “As Is” Basis: The Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied.
– No Guarantee: We do not guarantee the accuracy, reliability, or completeness of any information provided through the Service. Your reliance on such information is at your own risk.

10. Limitation of Liability
To the fullest extent permitted by applicable law:
1. No Liability for Indirect Damages: We shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, revenue, or profits, arising out of your use of or inability to use the Service.
2. Aggregate Liability: Our aggregate liability to you for any claims arising from your use of the Service will not exceed the total amount paid by you, if any, in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless StressLess AI and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with your violation of these Terms or your misuse of the Service.

12. Governing Law & Dispute Resolution
– These Terms are governed by and construed in accordance with the laws of European Union, without regard to conflict of law principles.

13. Modification & Termination
– Changes to Terms: We may update or modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website with a revised “Last Updated” date. Your continued use of the Service after changes become effective will signify your acceptance of the updated Terms.
– Termination: We reserve the right to suspend or terminate your access to the Service at any time, without notice, for any or no reason, including if you breach these Terms.

14. Miscellaneous
– Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and StressLess AI regarding the Service.
– Severability: If any provision of these Terms is held invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
– No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
